1. The Platform

1.1 Description of Service

Wearframe is an AI-powered fashion photography platform that enables users to create professional, high-quality fashion model photos using artificial intelligence. The Platform operates on a credit-based system where users purchase credits to generate AI fashion photos.

1.2 Usage Limitations

Your right to access and use the Platform is limited, non-transferable, non-exclusive, non-assignable, and non-sublicensable. The Platform may only be used by individuals who:

• Can form legally binding contracts under applicable law
• Are authorized to use the Platform pursuant to these Terms
• Have created a valid account with accurate information

1.3 Modifications to Service

Wearframe reserves the right to modify, update, or discontinue any aspect of the Platform at any time. For material changes, we will provide notice through the Platform, our website, or via email.

2. Account Registration

2.1 Account Creation

To use the Platform, you must register and create an account. We reserve the right to refuse registration or block access to the Platform at our discretion.

2.2 Account Information

You agree to provide accurate, complete, and current registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Security

You must notify Wearframe immediately of any breach of security or unauthorized use of your account. You are solely responsible for any losses or damages arising from unauthorized use of your account.

3. User Content and Data

3.1 Your Content

You retain all rights to the content you upload to the Platform ("User Content"), including photographs, images, and other materials. By uploading content, you grant Wearframe a license to use, process, and store this content for the purpose of providing our services.

3.2 Generated Content

AI-generated images and content created through the Platform ("Generated Content") are licensed to you for use in accordance with your purchased credits. You may use Generated Content for commercial purposes, including e-commerce, marketing, and social media.

3.3 Content Restrictions

You may not upload or generate content that:

• Infringes any intellectual property rights or privacy rights
• Is defamatory, abusive, harassing, or threatening
• Contains nudity, pornography, or explicit content
• Violates any applicable laws or regulations
• Misrepresents identity or impersonates others

4. Pricing and Payment

4.1 Payment Processing

All payments for Wearframe are processed by Lemon Squeezy, who acts as our Merchant of Record. Lemon Squeezy handles payment processing, invoicing, sales tax, and VAT compliance on our behalf.

4.2 Credit Purchases

Wearframe operates on a credit-based system. You purchase credits as a one-time payment, which can then be used to generate AI fashion photos on the Platform. Prices are displayed in your local currency where supported. All applicable taxes will be calculated and displayed at checkout.

4.3 Credit Usage

Credits are consumed when you generate AI photos through the Platform. The number of credits required per generation is displayed before you confirm. Unused credits remain in your account and do not expire. Credits are non-transferable between accounts.

4.4 Price Changes

Wearframe may modify credit pricing at any time. Price changes will apply to new purchases only and will not affect credits you have already purchased.

5. Refund Policy

5.1 No Refunds

All sales are final. Due to the digital nature of our AI-generated content and the immediate access provided upon purchase, we do not offer refunds for credit purchases. Please review our features, pricing, and these Terms carefully before making a purchase.

5.2 Unused Credits

Purchased credits remain in your account and do not expire. No refunds are provided for unused credits. You may use your credits at any time while your account remains active.

5.3 Exceptions

In exceptional circumstances, such as technical issues preventing access to the Platform that we are unable to resolve, refunds may be considered at our sole discretion. Any such requests should be directed to support@wearframe.com.

6. Intellectual Property

6.1 Platform Ownership

The Platform, including all software, algorithms, designs, and content (excluding User Content and Generated Content), is owned by Wearframe and protected by intellectual property laws.

6.2 Restrictions

You may not:

• Copy, modify, or create derivative works of the Platform
• Reverse engineer, decompile, or disassemble the Platform
• Remove any proprietary notices from the Platform
• Use the Platform to develop competing products or services
• Sublicense, sell, or redistribute access to the Platform

7. Termination

7.1 By You

You may close your account at any time by contacting us. Upon account closure, any remaining unused credits will be forfeited and no refunds will be provided.

7.2 By Wearframe

Wearframe may suspend or terminate your access to the Platform immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion.

7.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Any unused credits will be forfeited. You may download your Generated Content prior to termination. Wearframe may delete your data after termination.

8. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WEARFRAME DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS.

AI-generated content may contain inaccuracies or imperfections. You are responsible for reviewing and approving all Generated Content before use.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEARFRAME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

WEARFRAME'S TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE FEES PAID BY YOU IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Wearframe, its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your User Content, or your violation of these Terms.

11. General Provisions

11.1 Amendments

Wearframe may modify these Terms at any time. Material changes will be notified through the Platform or via email. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wearframe operates, without regard to conflict of laws principles.

11.3 Entire Agreement

These Terms constitute the entire agreement between you and Wearframe regarding the Platform and supersede all prior agreements and understandings.

11.4 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
